Terms and Conditions of Sale

1. Object

The present general terms and conditions of sale (T&Cs) aim to define the terms and conditions of sale for the services and products offered by HMANSECURITE, specializing in the installation of security systems, home automation, and Delta Dore thermostats.

2. Acceptance of the Terms and Conditions of Sale

Any order placed with HMANSECURITE implies full acceptance of these T&Cs by the customer.

HMANSECURITE offers the installation and maintenance of the following equipment:

4. Orders and Quotes

All orders are preceded by a free quote specifying the details of the services, pricing, and execution timelines. The quote must be validated by the customer before any intervention.

5. Prices and Payment Terms

The prices of services and products are indicated in euros, including taxes. A 30% deposit may be requested upon validation of the quote. The balance is due upon completion of the work. Payments can be made via bank transfer, cheque, or cash.

Any sum not paid by the due date will incur late penalties calculated at the legal rate in effect, along with a flat fee of €40 for collection costs.

6. Execution Deadlines

HMANSECURITE commits to meeting the deadlines indicated in the quote, subject to the availability of materials and external conditions (weather, site access, etc.).

7. Warranty and Responsibility

Installations performed by HMANSECURITE are covered by the following warranties:

• Legal Compliance Warranty: 2 years for individual clients, as per the Consumer Code.
• Hidden Defects Warranty: 2 years from the discovery of the defect, as per the Civil Code.
• Commercial Warranty: An optional 6-month commercial warranty is offered to professional clients, unless otherwise stated in the quote.
• Warranty of Installed Equipment: The warranty duration of installed equipment corresponds to the manufacturer's warranty. HMANSECURITE is not responsible for the conditions imposed by the manufacturer.
• Warranty Exclusions: Any damage resulting from improper use, lack of maintenance, modification by a third party, or external causes (e.g., power surge, lightning) will not be covered by the warranty.

8. Retention of Title

The equipment installed remains the property of HMANSECURITE until the full payment of the invoice by the customer.

9. Force Majeure

HMANSECURITE shall not be held liable for the non-performance of its obligations in the event of force majeure, as defined by Article 1218 of the Civil Code.

10. Non-Solicitation of Personnel Clause

The client agrees not to hire or employ directly or indirectly any employee or subcontractor of HMANSECURITE for a period of 12 months following the end of the contract.

11. Right of Withdrawal

In accordance with current legislation, the client has 14 days from the signing of the quote to exercise their right of withdrawal, unless work has already begun with their agreement.

12. Complaints and Disputes

In case of dispute, the client can contact HMANSECURITE's customer service by email (hmansecurite@hmansecurite.fr) or by phone (+33 6 22 73 90 68). If the disagreement persists, the dispute will be submitted to the competent courts.

13. Protection of Personal Data

The collected information is used only for order management and will not be shared with third parties without consent.

14. Final Provisions

HMANSECURITE reserves the right to modify these T&Cs at any time. The applicable conditions are those in effect at the time of the order.
